Appeal proceedings have been initiated by the African Democratic Congress (ADC) at the Supreme Court after the Court of Appeal upheld a ruling on the party’s state congresses.

The African Democratic Congress (ADC) has announced that it is heading to the Supreme Court to challenge the Court of Appeal judgment delivered on Monday, saying it respectfully disagrees with the ruling and considers it legally unsustainable.

The appeal follows a decision by the Abuja Division of the Court of Appeal, which upheld an earlier Federal High Court order restraining the Independent National Electoral Commission (INEC) from recognising state congresses conducted by committees appointed by the David Mark-led caretaker leadership of the party.

The appellate court, in a judgment delivered by Justice Okon Abang, ruled that there was no basis to set aside the restraining order issued by the Federal High Court in Abuja on April 29, 2026.

Reacting to the judgment, the ADC, in a statement issued by its National Publicity Secretary, Bolaji Abdullahi, confirmed that it had commenced the legal process to challenge the decision before the Supreme Court.

The party clarified that the judgment relates only to the ward, local government and state congresses conducted by the caretaker leadership.

According to the ADC, the ruling does not affect its direct primary elections through which candidates for various elective offices emerged across the country.

The party also drew attention to the dissenting opinion delivered by the presiding justice, arguing that it more accurately reflects the settled position of the law and supports the party’s legal position.

“We also note the dissenting judgment of the presiding justice, which, in our view, more accurately reflects the settled position of the law and the party’s position,” the statement said.

The ADC urged its members and supporters to remain calm and focused as the legal process continues. It reaffirmed its commitment to providing Nigerians with what it described as a credible political alternative and pledged to continue pursuing its objectives in accordance with the Constitution.
