A Shari’a Court in Kaduna has ordered a man to vacate his matrimonial home for his ex-wife and their six children while directing him to continue providing for their welfare and upkeep.

A Shari’a Court sitting at Magajin Gari, Kaduna State, has ordered one Tajuddeen Murtala to vacate his matrimonial home for his ex-wife, Hidayat Yusuf, and their six children.

The presiding judge, Malam Mu’awiya Shehu, also directed Murtala to continue taking full responsibility for the maintenance and welfare of the children.

The ruling followed a petition by Yusuf, who had approached the court seeking custody of their six children and financial support from her former husband.

Through her lawyer, Sadau Garba, Yusuf told the court that Murtala issued her a third divorce letter two weeks earlier while she was nursing their 10-month-old baby.

The counsel said Yusuf currently lives with the six children at Sardauna Crescent, Kaduna, and urged the court to grant her custody while directing Murtala to provide for their feeding, education, healthcare and clothing.

The lawyer also asked the court to compel Murtala to continue paying rent for the house where Yusuf and the children reside.

Garba further urged the court to order Murtala to vacate the property, arguing that the couple were no longer married and that his continued presence in the house could lead to an unpleasant situation.

The court adjourned the case until November 24 for further hearing.
