The Court of Appeal in Abuja has dismissed the rights violation case filed by Nnamdi Kanu against the Department of State Services and the Attorney-General of the Federation. The three-member panel held that the appeal no longer had practical value following his terrorism conviction.

The appellate court noted that Justice James Omotosho of the Federal High Court had, on November 20, convicted and sentenced the IPOB leader to life imprisonment. As a result, the panel ruled that the claims raised in the appeal had become academic. He had earlier challenged his detention conditions, alleging denial of healthcare, religious freedom, and human dignity.

Delivering the lead judgment, Justice Boloukuromo Ugo explained that since his legal team confirmed he is now held at the Sokoto Correctional Centre, the court cannot order a transfer to Kuje, which formed part of the reliefs sought. The judge added that the court could not grant further requests because Kanu had already been moved into the correctional system he previously preferred.

The panel concluded that the appeal lacked merit, stressing that no actionable issue remained after his conviction and relocation from DSS custody. With the matter effectively overtaken by events, the case was formally struck out, bringing this phase of Nnamdi Kanu’s legal battle to a close.
