Court dismisses charges against IPOB leader Mazi Nnamdi Kanu

The Federal Court of Appeal sitting in Abuja have discharged and acquitted the detained leader of the Indigenous People of Biafra (IPOB), Mazi Nnamdi Kanu.

The three man panel lead by Justice Jummai Hanatu that looked into the case said Kanu has no case to answer again as the Federal High Court does not have jurisdiction to try the matter in first place.

The Court held that Kanu’s arrest in Kenya and forceful transfer to Nigeria was illegal because proper procedure for extradition was not followed. They said he was brought into Nigeria illegally.

The Court further said that the federal government failed to say
the location where they arrested Kanu despite the weighty allegations leveled against him. The Court added that since they keep quiet, it meant that they agreed with what Kanu said that the Nigerian authorities kidnapped and brought him forcefully back to Nigeria.

The Court further held that it was against the law to detain and try Kanu in any court since they brought him back illegally.

“The final verdict is that the judgement of the lower court is set aside and Mazi Nnamdi Kanu is discharged and acquitted”

Nigeria is in breach of extradition treaty and laws and have breached Mazi Nnamdi Kanu’s fundamental human right.

Proceeding against Mazi Nnamdi Kanu in the Federal High Court is tainted with illegality, and
